PRIVACY POLICY & DATA COLLECTION NOTICE


HANGYO ICECREAMS PRIVATE LIMITED, a company incorporated under the laws of India, with its registered address at #301/302, Sterling Chambers, Kalakunj Road, Kodialbail, Mangalore – 575003 (“Company” or “we” or “us”) is dedicated to protecting your personal data and information, and taking reasonable security safeguards to handle and process this information appropriately. 

This Privacy Policy & Data Collection Notice (the “Privacy Policy”) is intended to inform you, as a participant in a Contest (“Participant” or “you”), about our data collection, processing, and usage policies and procedures. This Privacy Policy is in addition to any privacy policy that may be generally applicable to the users of Facebook / Meta, and Instagram.

This Privacy Policy applies to all the information we collect when you participate in a Contest. 

BY PARTICIPATING IN ANY CONTEST OR PROVIDING YOUR PERSONAL INFORMATION IN THE CONTEXT OF THE CONTEST, YOU CONSENT TO THE COMPANY COLLECTING, PROCESSING, SHARING, UTILISING, AND RETAINING YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY.


1. Definitions: For the purposes of this Privacy Policy, the following capitalised terms shall have the meanings set out below. Any terms capitalised, but not defined in this Privacy Policy shall have the meaning assigned to them in our Terms & Conditions.
  1. “Personal Information” is any data of, about, or in relation to you, or capable of identifying you, and shall include (as applicable), the Provided Information.
  2. “Provided Information” is data, information (personal or otherwise), details, and any other information you provide to us. 
  3. “Responses” are the your responses to trivia questions, your comments on our social media posts, and any other data related to a Contest provided by you.
      2. General Notice

        The Company reserves the right to, and may at any time, monitor, record, and store (electronically or otherwise) all communications and Responses made by you in the context of the Contest. 

        3. Information We Collect
          3.1. In general, we may collect information about your mobile phone, computer, tablet, or any other device (being the device through which you access the Contest and/or our social media pages), hardware, software, platform, media, internet Protocol (IP) address and connection, demographic information, data about your online activity such as feature usage and click paths, and other data that you may provide in surveys, feedback forms, etc. 
            3.2. We may also collect your Personal Information, including your name, date of birth, age, social media handle/username, address/s, contact number/s, e-mail address/s, residence status, and any proof / evidence requested in relation thereto, photograph/s,  gender, and any other information requested from you. 
              4.Cookies
              4.1. We use Cookies to help us gather and store information about visitors to our Contest page(s).
                4.2. You can delete Cookies at any time or you can set your browser to reject or disable cookies.
                  4.3. We may use information from cookies for the following purposes:
                    1. Traffic monitoring, e.g., the IP address from which you access the Contest, the type of browser and operating system used to access the Contest, the date and time of your access to the Contest, the pages you visit, and the Internet address of the website from which you accessed the Contest;
                    2. To recognise repeat visitors for statistical / analytical purposes; and
                    3. Anonymous tracking of interaction with online advertising, for example, to monitor the number of times that a banner ad is displayed and the number of times it is clicked.
                    5. How do We Collect Information?

                    We collect information that may be used to identify you, and that is not otherwise publicly available, including, in the following ways: 

                    1. When you voluntarily provide it by participating in a Contest, or any other interactive elements of the Contest;
                    2. When you engage with the Contest, including responses to trivia questions, posting photographs / stories / posts in relation thereto, and other data generated during your participation; 
                    3. When you request updates or otherwise subscribe to communications from us; and/or
                    4. When you participate in a survey, request customer support, or otherwise communicate with us.

                    6. Purpose for Collection & Processing 

                      6.1. We collect your information to:
                        1. Ensure that the Contests are being administered and managed effectively;
                        2. Communicate with you regarding Contest updates, results, and related matters;
                        3. Respond to your comments, questions and requests;
                        4. Analyse and improve the Contest experience for you;
                        5. Detect and prevent cheating, hacking, fraud, unauthorised participants, contesting by individuals below the age of eighteen (18) years, or any activity that violates or is inconsistent with the spirit or language of our Terms & Conditions or other Company policies.
                        6.2. Personal Information shared with us by you shall be confidential and used in line with data protection regulations under applicable law(s), and as set out in this Privacy Policy. 
                          6.3. We will keep confidential and protect your Personal Information except where disclosure is required or permitted by law, or unless you expressly consent to us sharing your Personal Information (for processing or otherwise).  
                            7. Retention Policy
                              7.1. We will retain your Personal Information as long as it is necessary for us to carry out the Contest and purposes in relation thereto.
                                7.2. When it is no longer necessary to retain your information, we will delete it, or anonymise and retain it for analytics and study purposes. This retention will be for a reasonable period, as needed to fulfill our analytics and study initiatives. 
                                  8. Security of Your Information

                                    We follow reasonable and accepted industry standards to protect the Personal Information provided to us, both during transmission and, once we receive it, for storage, transfer, and disposal. No method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use reasonable safeguards to prevent a breach of your Personal Information, we cannot guarantee its absolute security

                                    9. Third-Party Disclosure

                                      By entering a Contest, unless otherwise advised, you also agree that Company may use your Personal Information, or disclose it to other organisations or entities or individuals that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to you. Your Personal Information may be disclosed to government authorities and winners’ names, photographs, and other content and material depicting or in relation to you may be published on the Company’s website and/or social media pages. 

                                      10. Your Rights & Grievance Redressal

                                      10.1. You have the right, at any time to: 

                                      1. Withdraw your consent to our collection and processing of your Personal Information; 
                                      2. Correct, update, or complete your Personal Information provided to us; and
                                      3. Nominate any other individual, who in the event of your death or incapacity can exercise your rights mentioned above on your behalf.

                                      10.2. Please be aware that if you withdraw your consent to our collection and processing of your Personal Information, we will reserve the right to discontinue your participation in our Contests, which require the collection and/or processing of your Personal Information. 

                                      10.3. You may request erasure of your Personal Information collected and/or processed by us. However, please be aware that we reserve the right to retain your Personal Information if the purpose for which we have collected and processed your Personal Information is yet to be completed. 

                                      10.4. Our Grievance Officer (contact details below) will be your point of contact at the Company for any grievances, concerns, clarifications, or queries you may have about our collection and processing of your Personal Information. Our Grievance Officer will also guide and aid you, should you wish to exercise any of your rights mentioned above.

                                      You may also send a signed copy of a notice detailing your grievances to the registered office of the Company at #301/302, Sterling Chambers, Kalakunj Road, Kodialbail, Mangalore – 575003, addressed to the Grievance Office.

                                      11. External Websites/Mobile Applications

                                      The Contest may contain links to other websites/mobile applications. This Privacy Policy does not apply to such other websites/mobile applications. The Company is not expressly or impliedly responsible or liable for any loss or damage caused to you by the collection, processing, use, or retention of your data or Personal Information by such website/mobile application in any manner whatsoever. It is important that you review the privacy policies of all websites/mobile applications you visit before you disclose any information to such websites/mobile applications.

                                      12. Changes to Privacy Policy

                                      As and when the need arises, we may, in our sole discretion, alter this Privacy Policy in accordance with the latest technology, trends and/or for the purpose of compliance with applicable laws. We will notify you of these changes via e-mail, informing you that this Privacy Policy has been altered/amended, and that you, as a participant will be required to consent to such modifications or changes in the Privacy Policy. You may reach out to our Grievance Officer (contact details in Paragraph 10.4 above) if you have any queries about any changes made to our practices.

                                      13. Change of Control

                                      If the ownership or control of the Company, your Personal Information may be transferred. If such a transfer results in a material change in the use of your Personal Information, Company will use its best efforts to provide you with a notice about the rights and choices you have under applicable law to decline to permit such a transfer.

                                      14. Governing Law 

                                      This Privacy Policy shall be governed by the laws of India and any disputes arising out of or in connection with this Privacy Policy shall be subject to the jurisdiction of courts/statutory authorities of competent jurisdiction in Mangalore, India.
